Agreement between You and Dadabhai Travel LLC. 

Thank you for visiting dadabhaitravel.ae (the "Web Site"). The Web Site is offered by us, Dadabhai Travel LLC conditioned on acceptance by you, the user of the Web Site, without modification, limitation or qualification, of the terms and conditions contained herein. By accessing and using this Web Site, you are deemed to have agreed to all such terms and conditions (the "Agreement"). 

You represent and warrant you possess the legal right and ability to enter into this Agreement and to use this Web Site in accordance with all terms and conditions herein. 

You promise to us you are old enough to enter legally binding contracts through this Web Site and you know you will be responsible for all payments due to us for bookings made by you or another person using your login information. 

Modification of Terms 

We may change these terms and conditions at any time without advance notice. Changed terms will become effective once posted on the Web Site, and will not have any retrospective effect on existing contractual arrangements made through this Web Site. Your continued use of this Web Site after any change means you have accepted the changed terms and conditions.

Your access to and use of software and other materials on, or through, this Web Site is solely at your own risk. We make no warranty whatsoever about the reliability, stability or virus free nature of such software.

Any carriage by air using a ticket obtained using this web site shall be subject to the conditions of carriage of the relevant carrier and may also be subject to the warsaw convention or the montreal convention, which may limit the carrier's liability in certain circumstances. You should refer to the note on conditions of carriage set out below.

You agree to use the Web Site's services to make only legitimate reservations or purchases. You agree not to make any false reservation or any reservation in anticipation of demand. We may cancel, without notice, all confirmations associated with multiple reservations to one or more destination on or about the same date. 

You agree to all of our terms and conditions of purchase, including, but not limited to, full and timely payment of all amounts due and compliance with all rules concerning availability of fares, products, or services. All fees, assessments, charges, taxes and duties arising out of use of the Web Site are your sole responsibility.
  • You agree to not abuse the Web Site. "Abuse" includes, without limitation, using the Web Site to:
  • Defame, harass, stalk, threaten, abuse or otherwise violate others' rights as defined by applicable law.
  • Harm or interfere with the operation of others' computers and software in any respect, including, without limitation, by uploading, downloading or transmitting corrupt files or computer viruses.
  • Violate applicable intellectual property, publicity or privacy rights, including, without limitation, by uploading, downloading or transmitting materials or software.
  • Omit or misrepresent the origin of, or rights in, any file you download or upload, including, without limitation, by omitting proprietary language, author identifications, or notices of patent, copyright or trademark.
  • Transmit, post, or otherwise disclose trade secrets, or other confidential or protected proprietary material or information.
  • Download or upload files that are unlawful to distribute through the Web Site.
  • Transmit any information or software obtained through the Web Site, or copy, create, display, distribute, license, perform, publish, recreate, reproduce, sell, or transfer works deriving from the Web Site.

This Site is for the your personal, non-commercial use. You may not modify copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from this Web Site. Dadabhai Travel LLC and any other product or trade names of Dadabhai Travel LLC referenced herein are our service marks or registered service marks. Other product and company names mentioned herein may be the trademarks of their respective owners. 

Web Site Bookings 

You may book holidays, hotels, car hire, excursions and various land arrangements as offered in the website. All such bookings are valid only as per the conditions attached and governed by rules and regulations attached to such offers.

Modifications/Cancellations to your booking cannot be made on the Web Site; they must be made via our Dadabhai Travel LLC offices. You will then be subject to the rules that you agreed to when you confirmed the booking. You are required to contact one of our offices to arrange for any refunds. Cancellation charges/services charges as applicable will be levied as per rules and regulations/industry practice as applicable. You can pick up your tickets from locations listed during the booking process or you can choose to have your tickets delivered. Please note tickets can be collected only in Dadabhai Travel LLC offices in the UAE. Deliveries can only be made in emirates where Dadabhai Travel LLC offices are located. Delivery of tickets will be at a minimum charge. If you choose to collect tickets from one of our offices, it must be completed within the time specified during booking process, failing which your booking will be automatically cancelled. All online paper tickets need to be picked up from our offices within 24 hours, or get in touch with our representative with in 24 hours. Failure to do so may result in cancellation of the online booking. All e-tickets, tour vouchers may be delivered through email given and confirmed by you and you hereby agree to acknowledge receipt of the same. Failure of sending an acknowledgement may result in cancellation of tickets to avoid misuse of such documents. Once delivered, all changes made on such documents will be at your responsibility and risk unless otherwise such changes are made through Dadabhai Travel LLC as per stipulated rules and regulations. All changes modifications should be done through Dadabhai Travel LLC only. Dadabhai Travel LLC will not be responsible for any changes/modifications done on any of our travel documents through/with a third party irrespective of their status and nature of business.

Personal Profile and Login 

The users of the Web Site wishing to make a booking must register. Once you register, your personal information such as your ticket delivery address, your contact details as well as other details and preferences can be stored in the profile. We recommend you fill in your personal preferences as this information will assist us in providing you with our optimum service and will also save you time for future inquiries and bookings. Please remember not to give your Login/ID and password to anyone. 

Use of Credit card 

We accept only Visa and MasterCard credit cards. Your credit card will be debited when you click on the confirm button. If you do not have a credit card, you may choose to pay in cash while visiting one of our offices. 

Security 

We will take all reasonable measures to insure information you transmit to us using the Web Site will remain confidential and protected from unauthorized access. Despite those measures, we do not warrant unauthorized access to that information can never happen. We will not be liable for any such unauthorized access unless caused solely by our gross negligence, in which event you will be entitled to compensation up to a maximum of the value of the services purchased by you. 

Passports 

Please insure you have a passport valid for the duration of your trip. (Some destinations require your passport be valid for a certain length of time; in general, 6 months after completion of travel). You may also be required to obtain a visa for some destinations and it is your responsibility to do so. If you require any further information on passport or visa requirements, please contact one of our local offices or the embassy of the country to which you will be travelling. 

Airport Taxes 

Some airports will levy an airport departure tax, which is payable by passengers at the airport locally. Information on these charges is not given through our quoted fares. 

Health /Insurance Requirements 

Immunization may be recommended or required for your destination or stopover points - please check this with your doctor. We also recommend purchase of adequate travel insurance for all overseas travel. 

Conditions of Carriage 

The carriage of passengers and their baggage by air will be subject to the Conditions of Carriage of the carrier concerned. 

Privacy Statement 

Information collection and use: We are responsible for the processing of any personal information you provide to this Web Site. We take our responsibilities regarding the protection of personal information very seriously. This policy explains how we use personal information that we may obtain about you. By using our Web Site you consent to this use. 

Why do we need your personal information? 

When you use services provided on this Web Site you will be asked to provide certain information such as your name and contact details. We will store this information and hold it on computers or otherwise. We will use this information in the following ways: 

To fulfil our agreement with you, including processing your flight, sending you your itinerary, or contacting you if there is a problem with your reservation;

We need to know the names of all passengers travelling. If you are booking a flight on behalf of someone else, you must obtain their consent to use their personal information. We proceed on the basis that you have obtained this consent. How do we use your personal information? 

Information you provide or that is obtained by us will be used by us to enable us to review, develop and improve the services which we offer and provide you and other customers (via mail, email telephone or otherwise) with information about new products and services and special offers we think you will find valuable. We may also inform you about new products and services and special offers of selected third parties. 

Who do we share your information with? 

We may give information about you as follows:
  • to other companies and/or brands in the Dadabhai Travel LLC;
  • to trustworthy third parties that we use for the provision of certain services, such as enabling our customers to book hotels, chauffeurs, hire cars, flights or other services quickly and easily;
  • to anyone to whom we transfer or may transfer our rights and duties under our agreement with you;
  • to customs and/or immigration departments or other regulatory authorities in your country of departure and/or destination in order to comply with the law in those countries;
  • to third party organizations involved in credit card authorization;
  • if we have a duty to do so or if the law allows us to do so;
  • To our employees and agents to do any of the above on our behalf, now or in the future.
  • If you choose not to provide certain personal information we request, you will still be able to visit our Web Site but you may be unable to access certain options or services.

BOOKING TERMS AND CONDITIONS

BOOKING FORM:
All bookings must be completed through our online booking form available on our website. Bookings are only confirmed upon successful submission of the form and payment processing. In cases of urgent or emergency bookings, reservations may be made via email or phone, subject to availability.

CLIENTS RESPONSIBILITY:
It is the sole responsibility of the traveller to verify all travel documents before collection and departure. Travelers must ensure that the provided documents align with their booking request. Any discrepancies should be reported to the booking agent immediately for corrective action. The company is not liable for any errors or omissions once the documents have been reviewed and accepted by the traveller.

PAYMENTS:
A deposit or full payment must be made as per the tour conditions at the time of booking. Payments must be completed through our secure online payment gateway.

ACCEPTANCE OF TERMS & CONDITIONS:
By submitting the booking form and making a payment, the customer acknowledges and agrees to abide by Dadabhai Travel LLC’s terms and conditions. No physical signature is required, and acceptance of these terms is a mandatory step during the online booking process.

METHODS OF PAYMENT:
We accept only major credit cards, including Visa and MasterCard. Full payment must be made using a credit card, and guests are required to provide their credit card details to complete the transaction. The charge will appear on the guest's credit card statement as per the transaction details.

CONFIRMATION OF PAYMENT:
Once payment is successfully processed, our travel consultants will send a confirmation slip via email. A printed copy of this confirmation can be used as proof of payment to redeem your tour package. Please ensure that all travel details provided at the time of booking are accurate to avoid any discrepancies.

REFUND POLICY:

  • Refunds, if applicable, will be issued directly to the customer based on the booking conditions or company policy. Processing refunds typically takes 15 to 30 days, especially when waiting for payments from suppliers. To process a refund, customers must provide all original documents, unused vouchers, or proof of refund from suppliers. Without these, the company is not responsible for any extra charges from suppliers.
  • Many cruise lines, theatre ticket providers, apartment owners, and airlines apply full or partial cancellation charges once a booking is confirmed. Airlines may impose penalties for cancellations or changes, which vary depending on the fare rules. Customers should review airline policies before confirming a booking. The company is not responsible for these charges, as they are beyond our control.

CANCELLATION POLICY:
Each tour, activity, attraction, and hotel has its own cancellation policy. Clients must review the specific policy before confirming their booking.
General Cancellation Terms

  • If a combo tour is booked and a part of it is canceled, the combo offer will no longer be valid. The remaining tours will be charged at their individual prices, and only the balance amount will be refunded.
  • Tourist visa fees are non-refundable once payment has been processed.
  • When booking a combo package, clients must ensure that all selected options are available. If certain options are unavailable, only the confirmed tours and services can be availed.
  • Airline ticket cancellations and refunds are subject to the policies of the respective airline. Any cancellation fees, refund eligibility, or rebooking terms will be governed by the airline's rules and regulations. Clients are advised to review the airline's cancellation policy before confirming their booking.
  • Once a tour has commenced, no partial refunds will be issued.
Cancellation Charges
Once the booking is confirmed, cancellation charges will apply if the customer cancels any services. These charges are based on the total price of the services and may include the deposit paid.
  • Early cancellations: Refund eligibility depends on the tour and activity policy.
  • Closer to departure: The cancellation fee increases as the departure date approaches.
  • No-show: A 100% charge of the total price will be applied.
  • Once the tour has started, no partial refunds will be given.
Dadabhai Travel LLC will attempt to secure refunds for unused services; however, this is not guaranteed unless the supplier agrees in writing before services are cut short

NO-SHOW POLICY:
Failure to attend a booked tour or service will result in no refunds, either in part or full. This applies to unused tickets, sightseeing tours, car rentals, chauffeur-driven services, airport transfers, and other travel-related bookings. Rescheduling is not permitted for confirmed tours and services.

Chargeback and Refund Policy
No claim for a charge-back or refund will be accepted if the first mandatory service is delivered Additionally, no changes to the ordered services or the duration of the plan can be made, and no charge-back or refund can be requested during the contract period.

INSURANCE:
To ensure added security during your trip, we strongly recommend taking out travel insurance or any other relevant coverage for personal accidents, medical expenses, baggage loss, and more. Our agent is available to assist you in finding the right insurance for your needs.

TIME LIMIT:
Our agent will let you know the time limit for your reservation. Once the time limit expires, the booking will be cancelled, and the company is not responsible. It is your responsibility to make payments on time to avoid cancellation. Any cancellation fees or deposits paid will be lost if you don’t follow the booking terms and conditions. 

 Hotel Accommodation & Check-in – Check-out Policy:

  • Customers are responsible for ensuring they have the proper documents for their trip, especially if they’ve booked tours, transfers, or are visiting a different country. This includes having a passport (and visa if needed) or a valid ID card. No refunds will be given for missing or lost documents.
  • Our agents or suppliers use star ratings as a guide to help you choose accommodation. These ratings are for reference only and may differ from official standards, as they vary by country and hotel.
  • The usual hotel check-in time is 12 noon, and check-out is also at 12 noon, although this can vary. Some hotels may allow early check-in or late check-out depending on room availability, but this is not guaranteed. If you need early check-in, it’s best to book the room for the night before to ensure immediate access upon arrival.
  • If a hotel cannot provide the confirmed accommodation at the last minute, the company will help find a similar hotel. This is beyond our control, but we will do our best to avoid it.

CHILDREN REDUCTION:
Most hotels allow one child aged 2-12 years to stay in the parent's room, either with or without an extra charge. Some hotels may allow two children in the same room, with or without charge. This is typically without an extra bed. If an extra bed is needed, the hotel will charge an additional fee, which must be paid directly to the hotel. To avoid any issues during your holiday, it's recommended to pre-book an extra bed before you depart.

CHANGE BY US:
In rare cases, we may need to make changes to your holiday due to unforeseen circumstances beyond our control. If this happens, we will do our best to offer a similar holiday or alternative options. If you don’t agree with the changes, a full refund will be provided. However, no compensation will be given, as these changes are due to exceptional and unforeseen circumstances. We are not responsible for any losses or expenses you may incur in this situation.

CANCELLATION BY US:
We reserve the right to cancel any confirmed holidays if we believe it is not safe to operate due to unforeseen circumstances beyond our control. In such cases, you will receive a full refund or the option to rebook another holiday.

CHANGES TO YOUR FLIGHTS:
Most holidays are based on special airfares, and once your journey has started, flight changes are usually not possible due to airline rules, which are beyond our control. If you want to extend or shorten your stay, you will need to buy new tickets at the regular fare. Unused flight coupons may not be refundable.

PASSPORT, VISA AND HEALTH REQUIRMENTS:

  • Before your journey, you must ensure you have a valid passport, the necessary visas, entry permits, and any required vaccination certificates for the countries you plan to visit. These regulations may change, so it’s recommended to check your travel requirements in advance.
  • The agent, operator, and their staff are not responsible for the validity of your passport, visas, entry permits, health regulations, or other government requirements. However, they are happy to assist you with this process.

COMPLAINTS:
We strive to provide accurate descriptions of tours and hotels based on the information available at the time of booking. If any facilities or services don’t meet your expectations during your holiday, please contact the hotel manager immediately. It's too late to address the issue after your return. We investigate all genuine complaints but have little tolerance for those who seek to exploit the situation for a cheaper holiday at others' expense.

CONTENTS:
The information in brochures, flyers, and other materials is correct at the time of printing and is provided in good faith. However, the company is not responsible for any errors or changes after printing, as these can occur at short notice. Customers should check for any updates before finalizing their packages. While it’s impossible to ensure everything is printed exactly as needed, the company will do its best to provide accurate information when required.

DEFINITON:

  1. “Company” means Dadabhai Travel LLC.
  2. “Customer” means the person who signs the booking form or make the contract with the company
  3. “Contract” means the contract for the provision of services by the company to the customer.
  4. “Services” means any holiday or tour or other services offered by the company on behalf of a holiday or tour operator or other person who provides a service offered by the company.
  5. ‘Agent’/’We’ means staff of the company

LIABILITY OF THE COMPANY:

    I. The company and its agents act only in the capacity of agents for the customer in all matters pertaining to the services. All receipts, vouchers, coupons, tickets, exchange orders and any other documents are issued subject to the terms and conditions under which the services are provided. The company and its agents have no responsibility for the loss, accident, injury, damage, delay or irregularity that may be caused to person or property, however caused or arising during any holiday or tour under  its management, sponsorship, procurement or otherwise. Baggage and personal effects are always the customer’s  responsibility. The transportation when the customer is not on board a carrier or conveyance used or operated by the transportation companies or firms.

The passage contract in the use by the transportation companies or firms concerned shall constitute the sole contract between the transportation companies or firms and the purchaser of these tours and/or customers. The holiday or tour is issued and conducted at the sole responsibility of the holiday or tour operator and is not issued on behalf of, nor does it commit, airlines, or any airline whose services are used during the holiday or tour.

    II. The issuance by the company and acceptance by the customer of receipts, coupons, tickets, exchange orders or any other documents shall be deemed to be the consent by the customer of the terms of paragraph (I) above of these conditions.
    III. The company shall not be considered in breach of this contract or under any liability whatsoever to the customer for non-performance, part performance, defective performance or delay in the performance of any of the services or work carried out or to be carried out by the company or its employees, agents or sub-contractors hereunder which is directly or indirectly caused by or is a result of any circumstances beyond its direct control. Without prejudice to the generality of the foregoing, the following shall be regarded as such circumstances.

  Act of God, explosion, flood, lighting, tempest, fire accident, war, hostilities, invasion, act of foreign enemies, rebellion, revolution, insurrection, civil war, riot, civil commotion or embargoes, strikes, lockouts or other individual actions or trade disputes of whatever nature (whether involving employees of the company or third party); defaults of suppliers of any of the services or sub-contractors of such suppliers for any reason whatsoever, incompleteness or inaccuracy of any information which is the responsibility of the customer to provide. Any failure, default in performance, or any act or omission whatsoever on the part of the customer or its employees or agents.

IV. Should any of the circumstances referred to in paragraph (iii) above of these conditions occur before the departure date of the customer the company will endeavour but shall under no obligation, to offer alternative arrangements and shall make price adjustments as the company, in its sole discretion, considers reasonable in the case of any alteration to any holiday, tour or any other of the services. In the event of total cancellation under such circumstances a full refund of any deposit paid by the customer will be made.

GOVERNING LAW:

As Dadabhai Travel LLC has been an approved tour licensed company under Dubai Tourism & Commerce Marketing (DTCM), all services provided in accordance with the guidelines, rules and regulations of DTCM, which are updated from time to time.  This contract is also subject to these terms and conditions.

These conditions shall be construed according to the laws of the United Arab Emirates Courts, shall have exclusive jurisdiction in the event of any dispute between the customer and the company

                                   ALL TOURS ARE OPERATED BY DADABHAI TRAVEL LLC AS PER THIS TERMS AND CONDITIONS
